1. Acceptance of terms
These Terms of Use (“Terms”) are an agreement between you and Velamon (“Velamon,” “we,” “us,” or “our”), covering your use of our website and any of our ventures’ platforms, currently including Velamon Trade. By accessing our website, creating an account, or using our services, you agree to be bound by these Terms. If you don’t agree, please don’t use our services.
2. Who can use our services
Our services are intended for adults conducting business on their own behalf or on behalf of an organization they’re authorized to represent. By using our services, you confirm that:
- You are at least 18 years old
- You have the legal capacity to enter into these Terms
- Any information you provide to us is accurate and complete
3. Accounts on Velamon Trade
Velamon Trade works with two kinds of users:
- Farmers, who sell their produce to Velamon
- Buyers, who purchase food commodities directly from Velamon
To take part in either capacity, you’ll need to create an account. You’re responsible for:
- Keeping your login details confidential and secure
- All activity that happens under your account
- Notifying us promptly if you suspect unauthorized access to your account
You agree to provide accurate registration information and to keep it up to date.
4. Identity verification
To help keep transactions on Velamon Trade trustworthy and to prevent fraud, we require identity verification, which includes providing valid Ghana Card details. We may decline to activate an account, or may suspend an existing one, if we’re unable to verify your identity or if we believe the information provided is false or misleading. Details on how this information is handled are set out in our Privacy Policy.
5. Purchases and sales
Velamon Trade operates by purchasing food commodities directly from farmers and reselling them directly to buyers. Unlike a marketplace that connects two independent parties, Velamon is the buyer in transactions with farmers, and the seller in transactions with buyers — Velamon is a direct party to both sides, not a neutral intermediary.
In connection with these transactions:
- When you sell produce to Velamon as a farmer, the terms of that purchase (price, quantity, quality standards, and payment) are agreed between you and Velamon directly, in line with any sourcing terms we provide.
- When you buy from Velamon as a buyer, you are purchasing directly from Velamon, and Velamon is responsible for fulfilling that order as described.
- Payments are processed through Paystack, a third-party payment processor. Your use of Paystack’s payment services is also subject to Paystack’s own terms.
- You are responsible for the accuracy of any order or account details you submit on the platform.
6. Acceptable use
When using our website or platform, you agree not to:
- Provide false, misleading, or fraudulent information, including during identity verification
- Use our services for any unlawful purpose or in violation of any applicable law or regulation
- Interfere with or disrupt the operation of our website or platform
- Attempt to gain unauthorized access to any part of our systems or another user’s account
- Use our services to harass, defraud, or harm another user
We may investigate and take appropriate action, including suspending or terminating accounts, against anyone who violates this section.
7. Content and intellectual property
All content on our website — including text, graphics, logos, and the Velamon and Velamon Trade names and marks — is owned by or licensed to Velamon and is protected by applicable intellectual property laws. You may not copy, reproduce, or use our content or branding without our prior written permission, except as necessary to use our services as intended.
8. Disclaimers
Our website and platform are provided “as is” and “as available.” While we work to keep our services reliable and accurate, we don’t guarantee that they will be uninterrupted or error-free. As the seller of the food commodities offered through Velamon Trade, we take reasonable care to source quality produce and represent it accurately. However, because we deal in agricultural products, factors like natural variation in produce, farming conditions, and supply availability may affect quality or availability from order to order. Nothing in this section limits any warranty or protection you’re entitled to under Ghanaian consumer protection law.
9. Limitation of liability
To the fullest extent permitted by law, Velamon will not be liable for any indirect, incidental, or consequential damages arising from your use of our website or platform, or from purchases made through Velamon Trade — for example, losses beyond the value of the order itself. This does not limit our responsibility as the seller for the products we sell to you, or any liability that cannot legally be limited under the laws of Ghana.
10. Suspension and termination
We may suspend or terminate your access to our platform at any time, with or without notice, if we believe you’ve violated these Terms, engaged in fraudulent or harmful conduct, or if required to do so by law. You may also close your account at any time by contacting us.
11. Changes to these terms
We may update these Terms from time to time as our services evolve. We’ll post any changes on this page with a new “Last updated” date. Continued use of our website or platform after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the Republic of Ghana. Any disputes arising from these Terms or your use of our services will be subject to the jurisdiction of the courts of Ghana.
